These Terms of Service (“Terms”) govern your access to and use of the website operated by Inner Beauty Shop Inc., including innerbeautyshop.ca and any related pages, features, products and services offered through the website (collectively, the “Site”).

Throughout these Terms, “Inner Beauty Shop,” “we,” “us” and “our” refer to Inner Beauty Shop Inc.

By accessing the Site, creating an account or purchasing products from us, you agree to these Terms and to any policies incorporated into them by reference, including our Privacy Policy, Shipping Policy and Return & Refund Policy.

Nothing in these Terms limits or excludes any right or remedy available to you under applicable consumer protection legislation or other law that cannot legally be waived or restricted.

1. ELIGIBILITY AND USE OF THE SITE

You must be the age of majority in your province, territory or jurisdiction of residence to make purchases through the Site, or otherwise have the authorization of a parent or legal guardian where permitted by law.

You may use the Site and our products only for lawful purposes.

You may not use the Site in any manner that violates applicable laws, infringes the rights of another person, interferes with the operation or security of the Site, introduces viruses or malicious code, or attempts to gain unauthorized access to our systems or the accounts of others.

We may suspend or restrict access to the Site where reasonably necessary to protect our customers, business, systems or legal rights.

2. PRODUCTS AND PRODUCT INFORMATION

Inner Beauty Shop offers beauty, skincare, wellness, self-care and related products.

We make reasonable efforts to ensure that product descriptions, photographs, ingredients, sizes, pricing and other information appearing on the Site are accurate and current.

Product packaging, formulas, ingredients, appearance or other details may occasionally change as manufacturers or suppliers update their products. Customers should review the current product packaging, ingredient list, directions and warnings before use.

Colours and other visual characteristics may appear differently depending on your screen, device and display settings.

Product availability is not guaranteed. Certain products may have limited quantities, may be available only online or may be discontinued without notice.

We may reasonably limit quantities or sales, including in circumstances involving limited inventory, suspected fraud, unauthorized resale or other legitimate business concerns, subject to applicable law.

3. PRODUCT INFORMATION, WELLNESS CONTENT AND HEALTH CANADA COMPLIANCE

Inner Beauty Shop Inc. offers a range of beauty, skincare, wellness and related products. Products are sold and represented according to their applicable regulatory classification in Canada.

Information made available through the Site, including product descriptions, educational materials, articles, guides, social media content and other communications, is provided for general informational and educational purposes.

Such information is not intended to replace individualized medical advice, diagnosis or treatment from a physician or other qualified healthcare professional.

Cosmetics and Skincare Products

Cosmetic products are intended for cosmetic purposes, including cleansing, moisturizing, conditioning, beautifying or improving the appearance of the skin, hair or body.

Unless a product has been specifically authorized for therapeutic use under applicable Canadian law, statements regarding a cosmetic product are not intended to represent that the product diagnoses, treats, cures, mitigates or prevents a disease, disorder or medical condition, or modifies a physiological function of the body.

Customers should review the product label, ingredient list, instructions, cautions and warnings before use and discontinue use if irritation or an adverse reaction occurs.

Natural Health Products

Where a product is regulated as a natural health product in Canada, it should bear a valid Natural Product Number (NPN) or other applicable Health Canada authorization.

Any health-related representations regarding an authorized natural health product are intended to be consistent with its authorized uses, recommended conditions of use, dosage, cautions, warnings and other information approved by Health Canada.

Customers should use natural health products only according to the directions and warnings appearing on the product label.

General Wellness Information

Any discussion of ingredients, traditional uses, wellness practices, skincare techniques, massage, self-care or general wellbeing is provided for educational purposes only.

Such information should not be interpreted as medical advice or as a representation that a product or practice can diagnose, treat, cure, mitigate or prevent a disease or medical condition unless that representation is specifically authorized under applicable Canadian law.

Individual responses to skincare, cosmetic and wellness products vary. Results are not guaranteed.

If you are pregnant or breastfeeding, have a medical condition, take prescription medication, have known allergies or sensitivities, or are unsure whether a product is appropriate for you, consult an appropriate healthcare professional before use.

In the event of any inconsistency between general information appearing on the Site and the legally required or Health Canada-authorized information appearing on a product label, the applicable product label and authorized conditions of use should be followed.

Nothing in these Terms limits any rights or obligations arising under the Food and Drugs Act, Natural Health Products Regulations, Cosmetic Regulations, consumer protection legislation or other applicable Canadian law.

4. PRICING, CURRENCY AND TAXES

Prices are displayed in the currency selected or otherwise indicated on the Site.

Prices may change from time to time. A price change will not affect an order that has already been validly accepted except where permitted by applicable law.

Applicable sales taxes are calculated and disclosed during checkout.

Any mandatory fee imposed by us will be disclosed before you complete your purchase as required by law.

Shipping charges, where applicable, will also be disclosed before checkout is completed.

For international orders, customs duties, import taxes, brokerage fees or other charges imposed by governments, carriers or third parties may apply. Where these charges cannot reasonably be calculated in advance, they are the responsibility of the recipient unless otherwise stated at checkout.

5. ORDERS AND PAYMENT

Submitting an order constitutes your request to purchase the products identified in your order.

Before completing checkout, you will have an opportunity to review your order, shipping information, selected products and applicable charges and to correct errors.

You agree to provide complete, current and accurate billing, payment, shipping and account information.

Payment must be made using one of the payment methods available at checkout.

By providing payment information, you represent that you are authorized to use the applicable payment method.

An automated order confirmation acknowledges that we have received your order. The legal status and enforceability of an order remain subject to applicable consumer protection legislation.

We may decline or cancel an order where permitted by law, including where payment cannot be authorized, fraud or unauthorized activity is reasonably suspected, the transaction is prohibited by law, inventory is unavailable where cancellation is legally permitted, or another legitimate basis for cancellation exists.

If we cancel an order after payment has been processed, amounts owing to you will be refunded in accordance with applicable law.

Nothing in this section gives us the right to cancel, change or alter a completed consumer transaction where applicable law does not permit us to do so.

6. SHIPPING AND DELIVERY

Available shipping methods, charges and estimated delivery times are displayed during checkout or in our Shipping Policy.

Delivery dates and transit times are estimates unless we expressly guarantee a particular delivery date.

Delays may occur due to carriers, weather, customs processing, labour disruptions, incorrect delivery information, high-volume periods or circumstances outside our reasonable control.

Any statutory rights you have regarding delayed, undelivered or incorrectly delivered goods remain unaffected.

Customers are responsible for providing an accurate and complete shipping address.

For international orders, the recipient is responsible for determining whether products may legally be imported into the destination country and may be responsible for customs duties, import taxes, brokerage charges or other third-party fees.

7. RETURNS, EXCHANGES AND REFUNDS

Returns, refunds and exchanges are governed by our Return & Refund Policy, subject always to any statutory rights or remedies that cannot legally be excluded.

Certain products may be ineligible for return once opened or used for legitimate health, hygiene or safety reasons where permitted by law.

Any such restrictions will be communicated through our Return & Refund Policy or applicable product information.

If an item arrives damaged, defective, incorrect or otherwise not in accordance with your legal rights, please contact us promptly at info@innerbeautyshop.ca.

Nothing in our Return & Refund Policy limits statutory warranties, remedies or other consumer rights applicable to your purchase.

8. SUBSCRIPTIONS AND RECURRING PURCHASES

Where we offer subscriptions, deferred purchases, automatic replenishment or recurring orders, the applicable price, billing frequency, renewal terms and cancellation conditions will be disclosed before you authorize the purchase.

By expressly agreeing to a recurring purchase, you authorize us or our payment processor to charge your selected payment method according to the disclosed schedule until the subscription ends or is cancelled in accordance with the applicable terms.

Any additional cancellation, renewal or notice rights provided under applicable law continue to apply.

9. PROMOTIONS, DISCOUNTS AND GIFT CARDS

Promotional offers, discount codes, gifts with purchase and other promotions may be subject to additional conditions disclosed with the promotion.

Promotions may have eligibility requirements, expiry dates, quantity restrictions or exclusions where permitted by law.

Any regular-price comparison, discount, savings representation or promotional claim made by us is intended to comply with applicable Canadian advertising and competition laws.

Unless otherwise stated, promotional codes cannot be combined.

Gift cards and store credits are subject to any additional terms disclosed when they are issued and to applicable provincial or territorial law.

10. CUSTOMER ACCOUNTS

You may be able to create a customer account through the Site.

You are responsible for maintaining the confidentiality of your account credentials and for ensuring that information associated with your account remains accurate.

Please notify us promptly if you believe your account has been accessed or used without authorization.

We may suspend or terminate an account where reasonably necessary because of suspected fraud, abuse, unlawful activity or a material violation of these Terms, subject to applicable law.

11. REVIEWS, COMMENTS AND USER CONTENT

If you voluntarily submit a product review, testimonial, photograph, comment or other content to us, you represent that you have the right to submit that material and that it does not infringe another person’s intellectual property, privacy or other legal rights.

You grant Inner Beauty Shop Inc. a non-exclusive, worldwide, royalty-free licence to display, reproduce and use content that you intentionally submit for publication or promotional use, subject to applicable privacy, advertising and consumer protection laws.

We may moderate or remove content that is unlawful, misleading, defamatory, abusive, fraudulent, infringing or otherwise inappropriate.

We will not materially alter a customer review or testimonial in a manner that misrepresents the customer’s opinion or experience.

12. INTELLECTUAL PROPERTY

Unless otherwise indicated, the Site and its original content, including text, photographs, graphics, designs, branding, logos, educational materials and other materials created by or for Inner Beauty Shop Inc., are owned by or licensed to Inner Beauty Shop Inc. and are protected by applicable intellectual property laws.

You may use the Site for personal, non-commercial purposes.

You may not copy, reproduce, distribute, modify, republish, sell, commercially exploit or create derivative works from our protected material without prior written permission, except where permitted by law.

Third-party trademarks, product names and intellectual property appearing on the Site remain the property of their respective owners.

13. THIRD-PARTY SERVICES AND LINKS

The Site may use or contain links to third-party services, including payment processors, shipping providers, social media platforms, apps and other websites.

Third-party services are governed by their own terms, policies and privacy practices.

We are not responsible for the content, availability, security or independent operation of third-party websites or services that we do not control, except where applicable law provides otherwise.

Our online store is hosted using Shopify’s e-commerce platform.

14. PRIVACY

Our collection, use, storage and disclosure of personal information are described in our Privacy Policy.

By using the Site, you acknowledge that personal information may be processed as described in that policy and in accordance with applicable privacy legislation.

15. SITE AVAILABILITY AND ERRORS

We make reasonable efforts to maintain accurate information and reliable access to the Site.

However, the Site may occasionally contain typographical errors, inaccuracies, omissions or technical issues relating to product descriptions, pricing, promotions, availability, shipping charges, transit times or other information.

We may correct errors and update information where permitted by law.

Nothing in this section permits us to retroactively alter or cancel a consumer transaction where applicable law does not allow us to do so.

16. DISCLAIMER AND LIMITATION OF LIABILITY

We make reasonable efforts to provide a secure and reliable Site, but we cannot guarantee that access will always be uninterrupted, error-free or free from technical problems.

To the fullest extent permitted by applicable law, Inner Beauty Shop Inc. will not be liable for indirect, incidental, special or consequential losses arising solely from use of the Site where such liability may lawfully be excluded.

Nothing in these Terms excludes, restricts or limits liability, statutory warranties, conditions, rights or remedies that cannot legally be excluded, restricted or limited under applicable federal, provincial or territorial law.

Nothing in these Terms excludes liability for fraud, wilful misconduct or any other liability that cannot lawfully be excluded.

17. INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless Inner Beauty Shop Inc. from third-party claims arising directly from your unlawful use of the Site, your infringement of another person’s legal rights or your material breach of these Terms.

This provision does not limit any consumer right or remedy available to you under applicable law.

18. CHANGES TO THE SITE OR THESE TERMS

We may update the Site, our products, services or these Terms from time to time.

The date of the most recent revision will appear at the top of this page.

Changes to these Terms will apply prospectively unless otherwise permitted by law.

Changes will not retroactively remove rights that have already arisen under a completed transaction.

Where applicable law requires additional notice or consent to a material change, we will comply with those requirements.

19. SEVERABILITY

If any provision of these Terms is determined to be invalid, illegal or unenforceable, that provision will be interpreted, limited or severed to the extent necessary and permitted by law.

The remaining provisions will continue in full force and effect.

20. NO WAIVER

Our failure to enforce any provision of these Terms on one occasion does not waive our right to enforce that provision or any other provision at a later time.

21. GOVERNING LAW AND CONSUMER RIGHTS

These Terms and our relationship with you are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-law principles.

However, if the consumer protection, language, privacy or other mandatory laws of your province, territory or jurisdiction provide rights that cannot legally be waived, excluded or restricted by contract, those rights continue to apply.

Nothing in these Terms requires a consumer to waive a jurisdiction, forum, statutory warranty, cancellation right, language right, remedy or other protection that applicable law prohibits us from excluding or restricting.

For customers in Québec, nothing in these Terms limits rights provided under applicable Québec consumer protection legislation, the Charter of the French Language or other mandatory Québec law.

22. ENTIRE AGREEMENT

These Terms, together with the policies and terms expressly incorporated by reference and any additional terms presented to you in connection with a particular product, promotion, subscription or service, constitute the agreement between you and Inner Beauty Shop Inc. concerning use of the Site and applicable purchases.

If a specific product, promotion or service has additional terms, those terms will apply to that product, promotion or service to the extent of any inconsistency, subject to applicable law.
